01
How to Enter
  1. The promotion commences on 3rd September, 2025 and closes at 5pm on 15th December 2025 (“Promotional Period”).
  2. To enter the promotion, you must: 
    1. Be an individual who is aged 18 years or over;
    2. Be a New Zealand resident who is eligible to purchase property (real estate) in New Zealand; 
    3. Be party to an unconditional Agreement for Sale and Purchase of Real Estate (“Agreement”) for the purchase of an apartment (“Property”) within the Promoter’s Olympus Development at 9 – 27 Olympus Street and 14 – 22 Hargest Terrace, Mt Albert, Auckland, during the Promotional Period; and
    4. Settle the Agreement in full as required under the terms of the Agreement.
  3. Employees of the Promoter and any agency involved with this promotion, and the immediate families of such employees, are not eligible to enter.  Immediate family includes the spouse, de facto partner, child, parent, or sibling.
  4. Incomplete entries, including Agreements that are not unconditional by the end of the Promotional Period or which fail to settle as required under the Agreement, will be deemed invalid.

The Prize and Prize Draw
  1. This is a one-off competition and there will be one winner drawn under supervision of David Nielsen, Barrister and Solicitor, on 12th December.
  2. The winner will be advised by phone call or email.
  3. The prize is the payment of the winner’s mortgage for 12 months, up to a maximum value of $NZ 42,888.00, on the following terms:
    1. The prize will be paid out in monthly increments in line with the average mortgage value in the Olympus Development, assuming a 20% deposit is paid;
    2. The average mortgage value of $600,000.00 is based on an $800,000.00 purchase price within the Olympus Development, with a 20% deposit;
    3. The prize is applied to the winner’s mortgage for the Property; 
    4. If the mortgage is split between different individuals or entities:
      1. The value remains the same as if it was a single $600,000.00 mortgage; 
      2. The prize will be paid in equal monthly payments to the named mortgage holders;
      3. The monthly prize payments will be allocated in proportion to the split of the winner’s mortgage;
    5. The interest rate to be applied in calculating the prize payments will be the 1-year fixed rate with Westpac at the time of the draw;
    6. The prize will be paid in 12 monthly payments to the winner’s nominated mortgage account, commencing on the first day of the month following the settlement date of the purchase under the Agreement; and
    7. If the Property is sold within the first year from the settlement of the purchase of the Property, the balance of the prize is forfeited from the date of settlement of such sale.
  4. The prize is not transferable, changeable, or redeemable for cash. 
  5. The Promoter may amend, suspend, or cancel any aspect of the promotion (including the prize), in its sole discretion, if this promotion fails to achieve the sale of 40 apartments within the Olympus Development during the Promotion Period.
  6. In the event that the promotion is cancelled under rule 12 above, each eligible entrant shall receive a Prezzy Card to the value of $1,000.00.  This rule 13 shall not apply in the event that:
    1. The entrant has received any other purchase offer or incentive (as determined by the Promoter in its sole discretion) offered by the Promoter; and/or
    2. The promotion is amended or suspended in circumstances where the prize is still available to be drawn.

Further terms in relation to the prize and the winner
  1. In the event that the winner:
    1. Is not contactable; and/or 
    2. Fails to advise their nominated mortgage account(s), in writing, within [no.] working days of the prize draw, and/or Fails to settle the purchase of the Property, in full, as required under the terms of the Agreement, the Promoter reserves the right to redraw the prize under the original terms of the prize draw.
  2. In the event that the prize becomes unavailable for any reason beyond the Promoter’s control, the Promoter may in its sole discretion decide to provide an alternative prize.
  3. Neither the Promoter, nor any other entity associated with this promotion, will be responsible for any late, lost, misdirected, corrupted, incomplete, or invalid entry, including but not limited to entries not received due to technical problems or human error.  The time entries are deemed to be made will be the time the Agreement is notified as unconditional by the purchaser under, and in compliance with, the Agreement. 
  4. The Promoter reserves the right to disallow entries in its absolute discretion and without giving reasons. 
  5. The Promoter may share your information, including name and contact details, with other persons or entities that assist in running the promotion.
  6. The Promoter reserves the right, at any time, to verify the validity of entries and determine the eligibility of entrants (including an entrant’s identity and age) and to disqualify an entry or refuse to award the prize where false or misleading details have been given by an entrant, or where an entrant has behaved in a fraudulent or dishonest manner, or otherwise than in accordance with these terms and conditions or the spirit of the promotion. 
  7. By entering this promotion, you agree to the use of your name, photographs, and likeness for promotional/advertising purposes without charge, and agree to make yourself reasonable available for this purpose.  The ensuing copyright will rest with the Promotor, without any claim to compensation by you.
  8. You acknowledge and agree that you will comply with all instructions given by employees of the Promoter and other agencies associated with this promotion and agree not to do anything that may bring the Promoter into disrepute. 
  9. You agree that, as a condition of receiving the prize, you may be required to execute a waiver and indemnity in the form provided by the Promoter. 
  10. If you cannot accept the prize for any reason, that prize will be void and no compensation will be payable. 
  11. Failure by the Promoter, to enforce any of its rights at any stage does not constitute a waiver of those rights.
  12. All decisions made by the Promoter, its employees or agents are final, and no correspondence will be entered into.
  13. Except for any liability that cannot be excluded by law, the Promoter (including its officers, directors, shareholders, employees, advisors, assignees, agents, licensees, representatives, advertising and promotional agencies), excludes all liability (including negligence), for any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of this promotion, including, but not limited to, where attributable to any of the following:
    1. Any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); 
    2. Any theft, unauthorised access or third party interference; 
    3. Any entry or prize claim that is late, lost, altered, damaged or misdirected; 
    4. Any variation in the prize; 
    5. Any tax liability incurred by a claimant or entrant; or 
    6. Use of the prize.
  14. As a condition of participating in the promotion, you indemnify the Promoter, and all other persons and organisations associated in any way with the promotion, against all claims, damages, liabilities, costs, and expenses (including legal fees on a solicitor and client basis), which you may incur arising out of your participation in the promotion, howsoever caused.

Privacy and personal information
  1. You acknowledge that the Promoter collects and holds personal information provided by you.  Failure to provide requested personal information may disqualify you from entering this competition.  
  2. All personal information provided by you will be held by the Promoter. Under the Privacy Act 2020, you have the right to access and correct any such personal information.  You may access and request correction of any of the details about you held by the Promoter, by sending an email to zoe@elaman.co.nz.

Other legal bits
  1. If any provision of these terms and conditions is found to be unenforceable, illegal, or invalid, the rule is deemed modified to the extent required to remedy the illegality, unenforceability, or invalidity.  If modification is not possible, the rule will be treated as severed from these terms without affecting any other rule.
  2. These terms and conditions are governed by the laws of New Zealand and you submit to the non-exclusive jurisdiction of the New Zealand Courts.
